Terms of Service

The agreement between you and GuardMyTrade. Please read it — especially the parts about trading risk and what the service can and can't guarantee.

These Terms of Service ("Terms") govern your access to and use of GuardMyTrade's apps and services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What GuardMyTrade is — and isn't

GuardMyTrade is a self-discipline tool that enforces trading rules you set. It is not a broker-dealer, exchange, investment adviser, or financial planner. We do not provide investment, financial, tax, or legal advice, and nothing in the Service is a recommendation to buy, sell, or hold any security.

2. No guarantee of results

Trading involves substantial risk, including the loss of your entire capital. GuardMyTrade helps you follow your own rules; it does not guarantee profits, prevent losses, or guarantee any trading outcome. Your trading decisions and results are your own.

3. How enforcement works (and its limits)

When you break a rule you've configured, the Service locks your trading and may flatten open positions to bring you to a flat state. Locks hold until their scheduled release. There is no casual override: an in-app coach helps you wait out the moment, and a strictly limited number of lifetime early releases exist for genuine situations; a human support path exists for true emergencies.

Enforcement is best-effort and depends on factors outside our control — including your broker's systems and connectivity, your internet connection, your devices, and market conditions. We do not warrant that the Service will detect every rule event, execute every action instantly, or that flattening will occur at any particular price. You remain responsible for your account at all times.

4. Broker connections

To use enforcement, you connect a brokerage account and authorize the Service to read your account and place closing orders on your behalf solely to enforce your rules. You represent that you are authorized to connect that account. We never withdraw funds, transfer money, or open new speculative positions. Your relationship with your broker is governed by your agreement with them.

5. Your responsibilities

  • You choose your own rules and are responsible for whether they suit your strategy and risk tolerance.
  • You are responsible for all trading decisions and their outcomes.
  • You will keep your login credentials and devices secure, and use the Service in compliance with applicable law and your broker's rules.
  • You will not attempt to circumvent, disable, or tamper with the enforcement features in a way that defeats their purpose.

6. Availability

We work to keep the Service reliable, but it is provided on an "as is" and "as available" basis. It may be unavailable due to maintenance, outages, or factors beyond our control. We may modify, suspend, or discontinue features at any time.

7. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will catch or prevent any particular trade, loss, or rule event.

8. Limitation of liability

To the fullest extent permitted by law, GuardMyTrade and its providers will not be liable for any trading losses, lost profits, or any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Service — including any failure to detect a rule event, delayed or missed enforcement, or failure to flatten a position. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the twelve months before the claim.

9. Accounts & termination

You must provide accurate information and keep your account secure. You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or misuse of the Service. Note that cancelling does not lift a lock that is already active — an active lock still runs its scheduled course.

10. Changes to these Terms

We may update these Terms as the Service evolves. Material changes are indicated by the "last updated" date above, and where appropriate we'll notify you in the app or by email. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law provides otherwise.
